SUPERIOR COURT MINUTES BK 2, Walton Co. Ga.  [Dr. 123, Box 29, Ga.  Archives].  p. 324.  Aug.  Term, 1842.  The Central Bank of Ga. vs. WHITNELL(sic) H. ADAIR, garnishment.  Did not say for what debt.  "It appearing to the court that WM.  G. BULLOCK, WILEY J. SORRELLS, and DARKIS SORRILS (sic), have been duly notified to appear at  this term of court to answer as Garnshers (sic) in this case, and have not appeared, they are ordered to appear lst day next court." p.  22-23: The Court met agreeable to adjournment.   Present : Waters Briscoe, Warren J. Hill, Robert M. Echols, Judges of said Court this 18th May 1841.
ALEXANDER G. BULLOCK, JAMES N. SORRELS et al Vs.  DARCUS SORRELLS.  Walton Court of Ordinary, May Term 1841.
Whereas WILLIAM SORRELLS late of said county the farther (sic) of the said plaintiffs and husband of the said defendant has recently departed this (life) intestate and whereas the said DARCUS brings into court a writing purporting to be the last will and testament of the said WILLIAM..

1st.  Now the said plaintiffs at this term of the court came by their attorney, JAMES H. FOSTER  and deny that said writing is the last will of the said WILLIAM SORRELLS, because they say:  That said writing cannot be a legal will, not being executed in terms of the Statue of Frauds and perjuries regulating that matter.

2nd:   That the said WILLIAM, dec’d, was at the time of the execution of said writing in a state of mental imbecility produced from excessive intoxication and never afterwards when the free exercise of his reason was restored ratified the same.

3rd:  That taking advantage of the weakness of his nature and peculiar situation performed threats, violence, and persuasiveness(?) not to be resorted unto, the illegal means on the part of the said DARCUS to draw from the said WILLIAM said writing or illegal will.

4th:  That the said WILLIAM, dec’d, revoked said will at least intentionally.  So believing the same to be destroyed from the deceitful solicitations of the said DARCUS to him to make a will in reply to which he would sometimes say that the law was as good a will as he desired, at other times promise to do so but never did.  All of which matters and things the said plaintiffs are ready to prove and verify, or establish in such manner as the honorable court may be insistent on and of which the said plaintiffs pray the judgment of this court.

p. 24: Walton Court of Ordinary Adj’d Term May 1841,.  Whereas a will was brot(sic) into this court last term as the will of WILLIAM SORRELLS, late of said county, dec’d, and no sufficient proof being to establish the same as a legal and valid will, properly executed, ordered that said will be set aside and annulled for want of proper execution and legality.

p.51:  DARCUS SORRELLS, JAMES N. SORRELLS, JOHN H. SORRELLS, and DUDLEY RANSOM make $16,000 bond on 5 July 1841.  DARCUS and WILEY J. SORRELLS to serve as administrators of the WILLIAM SORRELLS estate.
p. 54.  WILLIAM G. BULLOCK, WILLIAM GRESHAM, and CALEB SAPPINGTON make bond in same amount for WILLIAM G. BULLOCK to also serve as administrator.
Returns F:2, 110, 485: Administrators list notes, cash on hand, taxes, and other small expenses paid. 7 Dec. 1842.  Lists more expenses and debts paid by the three administrators of William's estate.
9 Jan. 1844.  Lists small accounts paid.  Only the two male admrs. signing.  March Term 1847.

The INVENTORY & APPRAISEMENT of the ESTATE OF WILLIAM SORRELLS
was held 6 Sept. 1841, Walton Co. Return E--2:386-388: Included such items as pot ware, jars, churn, peuter, knives and forks, axes, plows, hoes, barrels, loom, spinning wheels, books, bookcase, desk, looking glass, dressing table, guns, jugs- cupboards, beds, chests, a clock, cotton gin and cotton, shoats, horses, cattle, oxen, and clothing.  One note of hand given by W.C. Mills for $16-931 due 9 Oct4 1840 was listed among the items and evidently had not been paid.

The personal property was listed as follows:  1 Negro Buck $125, 1 woman Lydha $500, 1 Premus(?) $300, 1 Betsy $250, 1 Girl Minny $50, 1 boy Ned $550, 1 boy Gordon $200, 1 woman Bridget & child $700, 1 woman Lucy $550, 1 girl Rose $600, 1 woman Hannah $350, 1 Penny & child, Sylva $750, 1 Margaret & Daniel $900, 1 boy Dave $350, 1 Girl Mary $375, for a total value of $6200.   Appraisers were Wm.  L. Anderson, Wm.  Gresham, and Paul Blasingame.  This record was recorded 24 Nov. 1841.

SALE OF THE PROPERTY OF WILLIAM SORRELLS, DEC'D
sold on a credit of 12 months, 30 Dec. 1841, Walton Co. Return E-2:467.  WILLIAM BULLOCK and WILEY J. SORRELLS bought most of the fodder, and WILLIAM BULLOCK, JAMES CLEGG, GEORGE L. NASON, BENNETT SORRELLS, JOHN H. SORRELLS, SEABORN IVY, DUDLEY RANSOM, JAMES SORRELLS, and THOMAS CLEGG bought the shoats.

WILL OF CHARLES SORRELLS

State of Georgia, Walton County.
In the name of God, Amen.  I, CHARLES SORRELLS, of Walton County, Georgia, being sound in mind but remembering my mortality, do make, publish, and declare this my last will and testament in manner and form following.

First, I commend my Soul to God and my body to be buried decently and properly, hoping and expecting life everlasting through the atonement of Jesus Christ.

I give to my wife, SARAH SORRELLS, and to her son, JOHN BENJAMIN SORRELLS, and to her son, FRANKLIN MADISON 8ORRELLS, and to her son, JAMES MONROESORRELLS, as joint tenants, the following lands, all lying in the third district of Walton County, to wit: Lot #57 and one acre part of Lot #46 being on its east side having a grist mill on said acre and that portion of Lot #22 which I have not deeded to LEONARD B. HAYES and Lot #55 and Lot #56 with the exception of that portion of it which I have deeded for the use of the Sorrell Spring Meeting House, and also with the exception of that part of it for which I have deeded to JAMES AUSTIN, and with the further exception of that part of it for which I have given said JAMES AUSTIN a title bond and also the north half of Lot #45, all which lands I devise in fee simple and so far as my said wife is concerned the same is devised to her for and in lieu of her dower.  I give and bequeath to my said wife one Negro girl, about five years old named Matilda, and four hundred dollars in cash, and I give her out of my stock, and she shall be privileged to choose for herself, one horse and three cows and calves.

I also give and bequeath jointly to my said wife and her three sons herein before named and her daughter, SARAH ELIZA SORRELLS, all my household and kitchen furniture, bedding and all of every kind and decription, also so much of my farming utensils as may be needful for cultivating the lands herein before devised and should there be a surplus of said utensils, of which my executors are to judge, such surplus may be sold by my executors.
I give to my daughter, said SARAH ELIZA SORRELLS, one yellow Negro girl, named Leah about nine years old, and four hundred and eighty dollars in cash, I give to my son, JOHN BENJAMIN SORRELLS, a Negro fellow named Jarrot about twenty-two years old, and to my son, FRANKLIN MADISON SORRELLS, a Negro fellow named John about twenty-one years old, and eighty-five dollars in cash, and to my son, JAMES MONROE SORRELLS, a Negro fellow named Aaron about eighteen years old, and eighty-five dollars in cash.

I give and devise to MRS.  JANE SORRELLS, widow of my deceased son, WILLIAM S. SORRELLS, and to her little daughter, ROSA, as joint tenants, all that portion of Lot #47, third district of Walton County, being on the southeast side of a branch running through said lot, for which portion I gave said WILLIAM S. SORRELLS my title bond dated 27 August 1847.

It is also my will and desire that if said JOHN BENJAMIN, FRANKLIN MADISON, JAMES MONROE, or SARAH ELIZA SORRELLS, one or more of them should, without leaving issue in life at the time, die, then the legacy or legacies given to them by this will shall go to and belong to the survivor or survivors among said last four persons.

And in as much as I have given to all my children by my first wife, various kinds of property at diverse times, now be it known that I do hereby confirm to each of those children all the property I have given them and will it to be inviolate.  I further will and desire that any child or children that I may have hereafter born shall be supported and raised out of the residue of my estate of whatever it may consist.  I will and direct that it be sold by my executors on a twelve months credit and after  the payment of my just debts, and the expenses of settling my estate and after payment of the cash legacies then  the net proceeds to be divided and paid over share and share alike and each share to be of the same amount.

One share to RICHARD W. SORRELLS, my son; one share to my son, CHARLES J. SORRELLS; one share to my son, RUSSELL B. SORRELLS; one share to my son-in-law, GEORGE WARE; one share to my son-in-law, HAMILTON WARE; one-half share to my daughter, ELIZABETH HOLTON and one half-share to her children; one share to my daughter, FRANCES BRIDGES, widow; one share to my son-in-law, LEONARD B. HAYES; one share to my son-in-law, JAMES AUSTIN; one share to my said wife, SARAH SORRELLS; one share to said JOHN BENJAMIN SORRELLS; one share to said FRANKLIN MADISON SORRELLS; one share to said JAMES MONROE SORRELLS; one share to said daughter, SARAH ELIZA SORRELLS; one-half share to said JANE SORRELLS and one-half share to said ROSA, her daughter.

I direct my executors to see that humane provision be made for any old or infirm negroes belonging to my estate.  In this matter they are to exercise their best discretion.  Lastly, I appoint WILLIS KILGORE, former Sheriff of Walton County, and ROBERT McCORD, executors of this my last Will and Testament.  In witness whereof I have hereunto set my hand and seal this 10th day of March 1849

Codicil: Whereas I did on 10 March 1849 execute and sign my last Will and Testa@ment, and whereas since that date, my son-in-law, JAMES AUSTIN, as well as my son-inlaw, GEORGE WARE, have both departed this life, leaving their wives who are my daughters, widows, and whereas I have concluded that I do not wish ROBERT McCORD to be an executor for me.  Now be it known that I have and do hereby declare this my codicil to my last Will and testament as follows:
MARY AUSTIN, widow of JAMES AUSTIN, to stand in the stead of JAMES AUSTIN as a legatee, and to receive as JAMES would have if he had remained in life.  Also, ,MILDRED WARE, widow of GEORGE WARE, to stand in the !stead of GEORGE WARE as a legatee.
Should any other son-in-law of mine present or future, die leaving any daughter or daughters of mine as widow or Widows, I will that such widowed daughter of mine shall stand in the stead of her husband as a legatee.  I declare it to be my will that my son, JOHN BENJAMIN SORRELLS, shall manage and take care of the legacy given my daughter, SARAH ELIZA SORRELLS, until she becomes of age or marries.  I hereby revoke the appointment of ROBERT McCORD as one of my executors.  I hereby again appoint WILLIS KILGORE executor of this my last Will and Testament and Codicil.  And I also appoint JOHN BENJAMIN SORRELLS executor of said will and codicil.   Dated 1 February 1854

On Monday, 7 August 1854, Charles D. Davis, Seaborn C. Burson, and Thos.  Gallaway made sworn statements that they saw Charles Sorrells sign the foregoing instrument as a codicil to his last Will and Testament.  On the same date, Willis Kilgore and John B. Sorrells produced the last Will and Testament of Charles Sorrells together with the codicil, along with affadavits of the subscribing witnesses (note was made that Benjamin White is now dead).  Letters of testamentary to the executors shall issue when they take the oath required by law.  Sworn to and recorded 1 November 1855.  S.J. Kennedy, Ord.

Contains his original will and codicil and 12 pieces of paper about his estate.   On 29 May 1858, paid BURREL H. WARE as legatee and also paid him as attorney in fact for JOHN H. HERRON.  s/BURREL H. WARE

On 15 Nov. 1858, paid ELIZABETH HOLTON as gdn. of her children Following legacies were paid in 1856:

SORRELLS, dec'd.  MARY AUSTIN; JAMES TANNER, gdn. of ROSA SORRELLS; W.S. and ELIZABETH HOLTON and their 2 children, PENNSYLVANIA and MORTIMER HOLTON: H. WARE in right of his wife; RUSSELL B. SORRELLS: and MILDRED WARE.   Estate paid the expense of going and returning to 'Collect purchase money for lot of land in Murray Co. Ga. for 3 days.

CHARLES B. SORRELLS FOLDER
Contains 3 pieces of paper dated 8 Feb. 1875 and 21 Sept. 1880.  First states he is "head of family consisting of himself and wife ALMEDA and 4 minor children" and he is listing goods to be exempt under the homestead tax exemption law.  Charles was ded'd by March 6, 1879.  A paper that lists Seaborn C. Burson as "next friend" names the appraisers of the estate as: H.B. SORRELLS, A.T. SMITH, JOHN W. DAVIS, ALLEN McCARTY, and WARREN McGaughey.  Minors listed in estate as: ESTELLE, CHARLES S., DAVID, SEABORN, and LILLIE SORRELLS.

CHARLEY SORRELLS FOLDER
Contains 1 mortgage for $200 to J.W. ARNOLD, Jr. on 21 June 1891, signed by SARAH E. SORRELLS giving as collateral her crop of corn and cotton on "my lands known as old Charley Sorrells place 4 miles above Monroe" and some stock.

ELIZABETH SORRELLS FOLDER
Contains 1 piece of paper.  CHARLES SORRELLS, SR. and CHARLES J. SORRELLS, JR. bond for $500 on estate of ELIZABETH, CHARLES SORRELLS, SR.  Admr.  Nov. 1831.  Book A, p. 25. [Note that this record does call Charles by Sr. and his son, Jr.]

MARY CATHERINE SORRELLS FOLDER
Daughter of CHARLES J. SORRELLS departed this life day of June "last." He is the sole legatee.  Aug. 1876.

SARAH SORRELLS FOLDER
Widow of CHARLES SORRELLS, SR.  Dec'd by 20 July 1876.  Part of Lot #45 in 3rd District, Walton Co. was sold to SEABORN C. BURSON, SR., measuring 125 ac.  Petition of ARCHIBALD TANNER to be Administrator.  Bond for $1500 with W.T. PERRY and R. AYCOCK, securities.  "House on road from Monroe to Tanner's Store near A.T. Smith's on  Lot #56, 3rd District of Walton Co., built by deceased and occupied by her until her death. "  In 1882, "All heirs-at-law, except FRANKLIN MADISON SORRELLS, who lives in Texas, served with notice of all proceedings."  Named heirs-at-law were:  Mrs. S.E. SMITH, wife of A.T. SMITH, JOHN B. SORRELLS, AND FRANKLIN MADISON SORRELLS.
