This is a working outline of the Joseph Jolly Sr. family of Union Co. SC., compiled by Thelma Faye Prince with the gracious assistance of Mary L. Henke in January 2000. With much regret I inform you that Mary L. Henke, a devoted long time Jolly family researcher, died of ovarian cancer on 21 December 2000. She was a great genealogist, very sharing and knowledgeable, and a great person to work with on this web page. I would like to dedicate this web page in loving memory of Mary L. Henke.
None of this is to be written in stone or taken in fact by anyone reading this account, unless you check it out for yourself. At this moment, we are still getting it together, it is not finished, so changes may be made at any time. The name Jolly is spelled this way throughout this account, because it is easier. You will also find the name spelled Jolley in the records themselves. You will find the compiler's remarks in parenthesis throughout this outline. My remarks are not part of the original record which I am remarking on. 2/05/2001 is the date of this revision.

1769 and was abolished in 1798. The 96th Dist. from 1785 to 1798
consisted of present day Union Co.

Abstracts & Misc. Records Anson Co.N.C. 1754. Petition signed by James Jolly seeking protection from the Indians. Living on "Ye headwaters of Thickity Creek" . [Anson formed in 1750. It later was divided making Mecklenburg; Mecklenburg was where Joseph's land was originally said to be located. Who is this James Jolly?]
Mecklenburg Co. NC Grants [later Union Co. SC]:
File 2031: Grant 456, Book 23, p. 40- Dated 27 April 1767. Joseph Jolly 600 acres on both sides of Thickety Creek, adj. Nathaniel Jeffries. William Tyron, surveyor.
Two identical plats were surveyed for Adam Gowdylock by William Tyron on 2 January 1767. Land adjacent to Joseph Jolly's land. Joseph and William Jolly were chain bearers. Joseph Jolly was also chain bearer for another 200 acres for Adam Gowdylock on 1 January 1767.
Joseph Jolly Sr. was Granted 300 acs in Craven County, Fairforest River, Branch Tinkers Creek, waters of Tyger River, bounded NW by _____ Hawkins, and on all other sides vacant land, 1 May 1767. Plat included.
On page 474 of Citizens and Immigrants-South Carolina abstracted by Mary Bondurant Warren is found this record: SAMUEL MCJENKINS [this may be Samuel McJunkins since he is found on the list of residents in 96th district made in 1779], 150 acres Berkley County in the fork between Broad and Saludy Rivers on a small branch of Tybee river known by the name of Tinkers Creek, bounded NE on JOSEPH JOLLY. Survey certified 4 December 1768. EDWARD MUSGROVE, D.S. For the memorialist, John ( -I-) Still, his mark.
Union Co. SC Deed Bk B:377. 4 March 1785. William Jolly and Frances, his wife, to William McCullough, all of 96th District, for 100 acs on the waters of Thickety and Guilkies Creeks "within a little of where the said creeks join into one." Part of a tract granted to Joseph Jolly, Sr. in 1767on northside of Thickety Creek, bounded by John Hope, Thickety Creek, Robert Lusk, James Brown and Guilkies. Signed by William Jolly and Frances (x) Jolly. Wit: Joseph Jolly, Sr., James Jolly, and Sarah (x) Jolly. Proved by James Jolly on 18 March 1790 before William Hendley, J.P. Recorded 30 June 1790. [Who is this James Jolly? Who is this Sarah Jolly, is she the wife of James, or some other relationship?]
Union Co. SC. 29 Dec 1785, Deed Bk A:66. Joseph Jolly, Sr. sold to John Hope of Union Co. SC for 50 lbs Sterling, 73 acs on South side of Thickity Creek, adjoining lands of the said John Hope and Hugh Taylor. Wit: Moses Meek, Agnes Meek. No recording date. [On this same date, Wilson Jolly and Mary, his wife sold some land to Moses Meek. See Wilson Jolly notes.]
Union Co. SC. Deed Bk A:257/258. 26 Aug. 1786. John Steen Sr and wife Martha of Union Co. SC to John Hope, same place, for 150lbs Sterling, 300 acs. on both sides of Thickety Creek including the mouth of Gilkies Creek, bound by said John Hope and Wm McCullough. Wit: Charles Miles, Joseph Jolly, and James Armstrong. Recorded 26 Sept. 1786. [I believe this is Joseph Jolly, Sr witness to this deed because his land did bound Wm Mc Cullough and John Hope at this time. Therefore this is the last record where Joseph, Sr. is alive].
pg. 198. Minutes of the Court. 5 March 1788. Thomas Brandon and Joseph Hughes administration is granted them on the estate of Joseph Jolly dec'd. who entered the bond according to law. [ This record definitely belongs to Joseph, Sr. because he died by 5 March 1788 when this adm. was granted. Joseph Jr. wrote a will 15 April 1778, and his administration was granted in July 1783 so he died before his father died. An administration is usually granted when the deceased died intestate, with no will. ]

[I think the above means that this is Joseph, Sr's estate, and the note given by the dec'd (SR) will be paid out to JR's estate.]
Ben Haile was the ordinary. He signed one of the small bits of estate paper which says "Account of Joseph Hughes of the estate of Joseph Jolly Sen. dec'd. Filed in my office 8 March 1802. Signed Ben Haile, Ordinary U.D." (Union District)
Joseph's estate papers show that John Still, Sr. signed for his wife's legacy with his mark, a -I- with a dash through it, dated 15 February 1791.

Benjamin Jolley 150 acres on forks of Broad River and Saludy called Tinkers Creek 22 April 1771.
Land Grant to Benjamin Jolly 2 April 1773 on Broad River & Saludy adj. to land layed out to Joseph Jolly.
He worked up in the Army during the Revolutionary War from Lt. to Major. He served as a Lt. and Captain under Capt. Palmer and Col. Brandon during 1779 and 1781. As a major under Col. Farr, he led a company of volunteers in the Battle at Cowpens. He is mentioned in the pension clain of Richard Addis, S21594 [Roster of S.C. Patriots of the Revolution, Moss, p. 508].
Minutes, pg. 198. 5 March 1788. Thomas Brandon and Jos. Hughes administration is granted them on the estate of Benjamin Jolly, Dec'd.
pg. 201. 5 March 1788. Ordered that John Sanders, Joseph McJunkin and John Montgomery appraise the estate of Benjamin Jolly dec'd and make due return thereof to our next court.
From Rev. War records: A large packet of receipts for Benjamin. He sold provisions to the army and also had pay slips, he was addressed as Capt. on a payday 9 Feb.1779 and as Lieut. on 16 Mar 1783.

2. JOSEPH2 JOLLY, JR. (JOSEPH1) was born Abt. 1740, and died Bef. 17 July 1783 in Union Co., 96th District SC. He married MARY _____. His records are presented in chronilogical order.
SC Camden District. land warrants, 200ac southside Broad River, on Cherokee Branch, laid out unto JOSEPH JOLLY a plantation or tract of land, bounded on SW Jesse Gates, SE John Picket, NE John Jondron, NW William Tate. Plat map included. 10 November 1774.
Joseph Jolly was mentioned in the widow's pension claim of John Jolly, R.S. W9276. Joseph served as a captain under Col. John Thomas and was on an expedition against the Indians and in the Florida Expedition during 1778 {Roster of SC Patriots in the American Revolution, p. 508. Bobby Gilmer Moss}.
Joseph, Jr. wrote a will 15 April 1778. I have a typed copy of the will (typed by who I can't tell you} which I received with the estate papers from Union Co. S.C. I will give it to you exactly the way it was given to me.
WILL OF JOSEPH JOLLY
IN, THE NAME OF GOD AMEN, the fifteenth of April 1778, I Joseph Jolly Capt of the District of 96, living on Brown’s Creek. Being sick in body but of good and sound memory thanks be to Almighty God for it calling to mind the uncertainty estate of this life and that all flesh must yield to God when He pleases to call. Do hereby make constitiute and ordain and declare this to be my Last Will and Testament in the Manner and form following.
Revoking and annulling by these presents all testaments, wills made before by me or declared either by word or writing . This only to be taken for my last will and testament and no other.
So for my last time give and commend my Soul to Almighty God My Saviour and my Body to be buried in such a place as it shall please my Executors hereafter mentioned to appoint now for the selling of temporal estates and such goods and chattles, lands, debts, as it please God to bestow upon me. I bequeath to my well beloved wife Mary her full third of her living except my land and her living on the land during her widowhood.
Next I give and beqeath to my son John when he comes of age, a good horse and two cows and my goats and ____ to my son John.
Likewise, after my wife’s third is taken out , all the remainder
of
my estate except the articles above mentioned be equally divided among
the
rest of my children.
Likewise, order that all my just and lawful debts legally brought in
be
compared with and paid.
Likewise, I constitute ordain and appoint Major Thomas Brandon,
Benjamin
Jolly, and my wife Mary to be Guardians so that Justice be done
according
to the above Will and Testament. Given under my hand and seal 15 April
1778.

I, William Jolly of Picken's Dist, being weak of body but of sound
mind
and memery. It is my will that after my death that all my
property of
every kind be sold at public sale. That credit of twelve months
be
given. That after all my just debts are paid the residue of the
money
be divided in this manner: To my son James Jolly, his son, and son in
law
one seventh part to be equally divided between them. To my son
Joseph
Jolly's widow one seventh part. To my dtr. Patsey Hunnicut to her
son
and daughter one seventh part equally divided between them. To my
son
William Jolly one seventh part deducting twenty five dollars
which
he owes me. To my son Jesse Jolly's child one seventh part,
deducting
from the said child 's part $100 which I give to Elenor Land. To
my
son Maxey Jolly one seventh part. To my son John Jolly one
seventh
part. Having given my land to my son William Jolly and to my son
John
Jolly's son the above property consists of negroes and other goods and
chattels.
